OPASTCO Urges Reform of Retransmission Consent; It Is a Broadband Issue

OPASTCO released a statement following the News Corp. blackout of Cablevision customers on Saturday, Oct. 16, which included both News Corp. cable television programming and Internet content.
     "The fact that a major programmer denied consumers access to online content highlights the very point that small broadband providers have been making for years: retransmission consent reform is a broadband issue," said OPASTCO President John Rose.  "Innocent consumers of video and broadband services should no longer be the victims of an outdated regime that favors broadcasters.  The current rules do not allow market forces to work, and reform is overdue."
 

FCC Chairman Julius Genachowski, Rep. Edward Markey (D-Mass.) and Sen. Deadline for One-Business Day Porting is Feb. 2, 2011

Deadline for small carriers to comply with the one-business day porting of simple wireline and simple intermodal port requests is February 2, 2011.

On May 13, 2009, the Commission adopted a Report and Order (the Porting Interval Order) reducing the porting interval for all entities subject to its local number portability (LNP) rules from four business days to one business day for simple wireline-to-wireline and simple intermodal port requests. Under the LNP rules, all providers follow the standardized fields, provisioning flows, and mandatory business hours. While most carriers were required to implement simple wireline and intermodal ports by August 2, 2010, small providers were given an additional six months to comply.

Any carrier that will not be able to meet this requirement should evaluate the possibility of obtaining a waiver or modification of the requirement. It is not expected that the FCC or state commission will be easily persuaded to grant relief from the Feb. 2 deadline, and carriers should make every effort to implement the new porting requirement (and carefully document their efforts to do so). FCC Announces Formation of the Technological Advisory Council; OPASTCO's John McHugh Appointed

The FCC announced the formation of the Technological Advisory Council (TAC), which will help the Commission identify opportunities for innovation and develop informed technology policies supporting domestic job creation and America's competitiveness in the global economy.  Among the topics that TAC expects to consider are recommendations made in the National Broadband Plan regarding broadband's role in job creation, education, energy conservation, and the delivery and cost-containment of health care.  For more information, please contact John McHugh, OPASTCO's technical director and TAC representative, at jtm@opastco.org or 202/833-2775.

FCC Releases White Paper on Mobile Broadband Spectrum

The FCC published "Mobile Broadband: The Benefits of Additional Spectrum," a white paper detailing technical and economic forecasts of mobile broadband market trends.  The Commission notes that the National Broadband Plan recognizes the exponential growth of mobile data usage and recommends that the FCC make available 500 MHz of new spectrum for wireless broadband within 10 years.   Both the full report and its highlights are available from the FCC website.

FCC Proposes To Draw From USF Funds To Support Its New "Mobility Fund"

At last week’s open meeting, the FCC adopted a Notice of Proposed Rulemaking (NPRM) seeking comment on using reserves accumulated in the Universal Service Fund (USF) to create a new Mobility Fund. According to the Commission, the purpose of the Mobility Fund is to significantly improve coverage of current-generation or better mobile voice and Internet service for consumers in areas where such coverage is currently missing, and to do so by supporting private investment. The Mobility Fund would use market mechanisms – specifically, a reverse auction – to make one-time support available to service providers to "cost-effectively" extend mobile coverage in specified unserved areas, the FCC says. This approach raises several issues, including whether small and rural carriers will be put at a major disadvantage vis a vis nationwide carriers in any reverse auction, and whether the reverse auction mechanism will reward installation of lower quality and less advanced technology. A question is also raised as to how the Mobility Fund will fit into the bigger USF picture, and whether the funds are better spent in other ways.
