STATE LEGISLATIVE NEWS

In an effort to keep you inform about what is going on at the State Legislative Session beginning February 2, 2009, the NTA will post those Bill Draft Requests (BDRs) and session bills that could have an impact on the industry.  The NTA and its Legislative Committee will be monitoring all BDRs and bills and keep you informed.  Bills and BDRs will be added or deleted depending upon relevance.  The following are those that the NTA is actively monitoring.  For Assembly (AB) and Senate (SB) bills, please click on the bill number to review that particular bill.

Bills:
  AB17  Revises provisions concerning persons who steal parts of streetlights and traffic-control devices. (BDR 15-643)
  AB32  Provides that no government, governmental agency or political subdivision of a government may be required to identify or mark the approximate location of certain sewer service laterals. (BDR 40-454)
  AB51  Authorizes counties to adopt by ordinance fees for conducting certain activities that result in the disruption of vehicular and pedestrian traffic on public roads and rights-of-way. (BDR 20-447)
  AB58  Revises provisions governing residential landlords and tenants. (BDR 10-636)
  AB80  Revises provisions relating to excavations. (BDR 40-483)
  AB90  Revises certain provisions concerning the investigation and prosecution of deceptive trade practices. (BDR 52-269)
  AB95  Revises certain provisions concerning the investigation and prosecution of unfair trade practices. (BDR 52-268)
  AB148  Requires certain health and safety training for construction workers and supervisors. (BDR 53-276)
  AB217  Prohibits minors from using cellular telephones and similar devices while operating motor vehicles. (BDR 43-32)
  SB51  Revises provisions governing the subpoenaing of public utility records by a law enforcement agency. (BDR 58-337)
  SB59  Revises provisions governing telephone systems used for reporting emergencies in certain larger counties. (BDR 20-471)
  SB79  Revises provisions governing various commissions, boards and committees relating to health. (BDR 38-327)
  SB82  Makes various changes relating to technological crime. (BDR 14-266)
  SB125  Prohibits the unauthorized possession, reading or capturing of another person's personal identifying information through radio frequency identification. (BDR 15-481)
  SB136  Prohibits certain persons from using a telephonic device to write, send or read a text-based communication while operating a motor vehicle. (BDR 43-776)
  SB138  Establishes the means by which a self-insurer of motor vehicles may provide proof of the ability to pay judgments obtained against him. (BDR 43-224)
  SCR6  Urges counties to map and document certain county roads to preserve rights-of-way over public lands in Nevada. (BDR R-467)

  54- 53   Makes various changes concerning transactions of scrap metal.
  53- 57   Makes various changes concerning workers’ compensation.
  59   Provides for a comprehensive study of existing taxes and the allocation of funding between state and local governments.
  54- 66   Revises provisions regarding the sale of certain recyclable materials.
  32- 81   Authorizes local governments to impose, increase, decrease and repeal certain taxes.
  53- 90   Makes various changes concerning workers’ compensation.
  115   Makes various changes concerning workers’ compensation.
  134   Makes certain changes concerning labor union representation.
  53- 590   Makes various changes relating to workers' compensation and industrial insurance.
  595   Makes various changes concerning lobbying disclosure.
  54- 614   Requires identification of person who sells scrap metal for recycling to reduce theft of certain metals.
  649   Revises provisions governing initiative petitions.
  0- 663   Clarifies that statutory definitions apply to administrative regulations.
  58- 790   Facilitates commercial roof access for telecommunication businesses.
  52- 818   Makes various changes concerning deceptive trade practices.
  839   Revises provisions governing certain business practices.
  52- 843   Requires a person soliciting donations for a charitable, non-profit or religious entity to make certain disclosures.
  58- 868   Enacts certain consumer protections for users of cell phones.

DC Circuit Court Upholds FCC Decision on Customer Retention Marketing

On Feb. 10, the United States Court of Appeals for the District of Columbia Circuit upheld unanimously a decision by the FCC that Verizon cease and desist its customer retention marketing practices that target customers who port their telephone numbers to a competitor.  Specifically, Verizon used information in a Local Service Request (LSR) sent by a competitor to create a marketing retention list, which was then used to target departing customers with special pricing and other promotions.

OPASTCO Encourages Congress to Shift Focus to USF Reform

On February 27, OPASTCO wrote to the leadership of the House Committee on Energy and Commerce and the Senate Committee on Commerce, Science and Transporation to urge that Congress turn its attention to reform of the Universal Service Fund (USF).  OPASTCO explained that should the funding for broadband included in the recent economic stimulus package prove successful in furthering broadband access to all Americans, there will be a greater need for a USF that explicitly and fully supports broadband infrastructure to continue meeting this goal.  OPASTCO also noted that it is eager to work with Congress, the White House and the FCC toward achieving realistic and sustainable reforms.

 FCC Issues Rules for Lifeline/Linkup Consumer Education Requirements

On Feb. 20, the FCC issued a Second Report and Order and Notice of Proposed Rulemaking (NPRM) regarding the June 12 digital television (DTV) transition deadline.  Included in the NRPM are guidelines for all eligible telecommunications carriers (ETCs) that receive Universal Service Fund (USF) support for Lifeline and/or Link-Up program customers, as these ETCs are obligated to notify these customers of the new deadline and how they may be affected.
     The FCC outlines several requirements on page 38 of the NPRM, including:

ETCs are to notify their Lifeline and Link-Up customers of the June 12 transition date via notices in monthly bill inserts or monthly stand-alone mailers (such as postcards or brochures) from April 1 through June 30.

All notifications must be printed clearly and easy to read.

These notifications must explain that although the deadline is June 12, some television stations may begin transmitting digitally at an earlier date, and that customers should pay attention to their local stations to find out when their stations will make the switch from analog to digital broadcast.  After the switch, analog-only television sets that receive programming via an antenna will need a digital converter box to continue to receive programming.

Broadband Stimulus

NTIA to Begin broadband Grant Program Meetings March 2

On March 2, the National Telecommunications and Information Administration (NTIA) will begin hosting meetings with parties interested in the broadband grant programs described in the Broadband Data Services Improvement Act and the American Recovery and Reinvestment Act of 2009.  All interested parties are invited to schedule a meeting.

National Associations Send Letter to President Obama for RUS, NTIC Administrators

OPASTCO, the Independent Telephone and Telecommunications Alliance (ITTA) and the Western Telecommunications Alliance (WTA) sent a letter to President Barack Obama asking that the new administrators of both the Rural Utilities Service (RUS) and the National Telecommunications and Information Administration (NTIA) "be nominated immediately and swiftly confirmed by the Senate" to ensure no delay in implementing broadband-related funding included in the American Recovery and Reinvestment Act.
