Red Flag Rules Effective Jan. 1, CPNI Compliance Due March 1

Federal Trade Commission's (FTC) Red Flag Rules is planned to go into effect Jan. 1, 2011, which will require all financial institutions and creditors, including those entities that provide goods or services and permit customers to pay at a later date, to implement an identity-theft prevention program to safeguard sensitive customer information.  Related, all telecommunications providers must file with the FCC by March 1, 2011, a certificate testifying to compliance with rules governing customer proprietary network information (CPNI) for the calendar year 2010. FCC Adopts Net Neutrality Order

The FCC adopted Dec. 21 an Order concerning rules governing net neutrality, more specifically network transparency and consumer access.  Among the rules contained in the Order are:

  • All fixed and mobile broadband network providers will be required to publicly disclose their network management practices, network performance characteristics, and commercial terms of service;
     
  • Fixed network providers will be prohibited from blocking access to lawful content, applications or services selected by a consumer;
     
  • Fixed network providers also will be prohibited from blocking a consumer from connecting legitimate devices to the network;
     
  • Mobile network providers will be prohibited from blocking access to lawful web sites and competing applications selected by a consumer;
     
  • Fixed network providers must not unreasonably discriminate among providers of lawful Internet traffic; and
     

The FCC will establish both formal and informal complaint procedures for review of practices that are alleged to be unreasonable or discriminatory. (Source OPASTCO 411, 12/29/10)

FCC Order Establishes Public Safety Mobile Broadband Network Standards

The FCC adopted an Order that establishes a technical framework for the interoperability of public safety mobile broadband networks that have been approved for state-, county- and city-wide construction and deployment.  These baseline technical requirements address aspects such as roaming capabilities, system identifiers, service coverage and secure communications.  A summary of the requirements can be found in the related news release. Proposed 1Q 2011 USF Factor Announced

FCC Approves NECA Modifications to High-Cost Loop, LSS Formula for 2011

The FCC's Wireline Competition Bureau has adopted an Order in which it has approved NECA's proposed modifications to the current high-cost loop and local switching support (LSS) formulas, which were submitted to the Commission in August.  The revised formulas go into effect Jan. 1, 2011.  (Source:  OPASTCO 411, 12-21-10)

NECA Issues Data Request in Response to Upcoming National Broadband Plan NPRMs

NECA recently issued a data request designed to better estimate construction costs to upgrade last-mile facilities.  This data will be used by the rural associations (NECA, NTCA, OPASTCO, WTA and the Rural Alliance) to respond to upcoming Universal Service Fund and intercarrier compensation Notices of Proposed Rulemaking (NPRMs) that will be published by the FCC in the near future.
     This data request is being sent to the engineering firms listed below, which represent rural ILECs.  If your company is a client of one of these firms, please contact and urge them to fulfill this data request by Jan. 7, 2011, or as soon thereafter as possible:

  • Midstate Consulting;

  • Palmetto Engineering and Consulting;

  • Head Networks;

  • CHR Solutions;

  • Finley Engineering;

  • RVW;

  • HunTel Engineering;

  • Monte R. Lee & Company; and

  • LADD Engineers

Once the data is collected and remitted to NECA, individual study area data will be kept confidential.

  43- 12   Prohibits texting while driving a motor vehicle.
